1. Scope
These Terms and Conditions are the basis for the Services provided to Users. The following Terms and Conditions govern the use of the online Game Xbattle.
1.1 Users
1.1.1 The game is only offered to consumers within the meaning of Section 13 of the German Civil Code (BGB).
1.1.2 Persons who have reached the age of 18 or whose legal representatives have approved the are entitled to use.
1.1.3 When registering to use the Game, the user insures his legal age and legal capacity or, in the case of minors, the consent of the legal representative.
1.2. Usage
1.2.1 As part of the technical and operational possibilities, the Users are offered the participation in the Game offered on the Internet.
1.2.2 Use is made possible by providing the Application on the Game website or on another freely accessible platform.
1.2.3 The Game content offered can be used with a Personal Computer or a Mobile device.
1.2.4 An account registration is required to participate or use the Game. This registration takes place exclusively in the Application.
1.2.5 The account registration takes place by filling out a form, entering various information and verifying the specified E-mail address. After creating a Game account, the use of the Game is guaranteed.
1.3 Object of the Contract
1.3.1 Xbattle provides certain information and enables Users to put their own information online, to create user Profiles that can be viewed by other Players and third parties. The User can use Xbattle to communicate with third parties, exchange digital content, carry out evaluations and carry out transactions.
1.3.2 The use of multiple accounts is prohibited and can be punished with immediate blocking of the User.
1.3.3 The Game may only be used with the Application provided. Decompiling the Application and changing the source code is prohibited. The use of other tools that influence gameplay or the Server is expressly prohibited. Systematic or automatic control of the Game with the use of Software is not permitted.
1.3.4 There is no right to open a Game account or to publish your own information.
1.3.5 The User has only one right to use the latest version of the game. The game is constantly being changed, updated, adapted and expanded.
1.3.6 The Game in the basic version and its use is free. However, other advantages or features are only available to paying Users.
1.3.7 The User has no right to maintain the Game. Operation of the Game can be stopped at any time and for no reason. In this case, the User can request reimbursement of fees paid in advance.
2. Conclusion of Contract
2.1 Der Nutzer gibt nach Ausfüllen des Registrierungsformulars und der Bestätigung der E-Mail Adresse in der Applikation ein verbindliches Angebot zum Abschluss eines Spiele- und Servicenutzungsvertrages (auch “Nutzerantrags”) ab. Die dafür auszufüllenden Datenfelder des Registrierungsformulars sind vollständig und richtig auszufüllen.

3. Right of Withdrawal
Within two weeks, the User can revoke his explanation of the conclusion of the Game and Service agreement and the ordering of premium features in text form without giving any reason. The period begins at the earliest with the receipt of this instruction.

4. Perusal of Terms and Conditions
4.1 The User accepts the Terms and Conditions after sending the User Application and continuing to use the Game.
4.2 The Terms and Conditions can be adjusted at any time in the future if this appears necessary.
4.3 A change in the Terms and Conditions will be announced in text form.
4.4 Within 14 days after the announcement the change of the general Terms and Conditions can be rejected. The new General Terms and Conditions will come into effect if the User has not repeated them in writing within the 14 days period or if the Game is still used. If repetition is made in due time, the contract can be terminated from both parties. The original Terms and Conditions apply until the end of the contract. In this case, paid services will be reimbursed pro rata. Further claims of the User are excluded.
5. Accessibility
Accessibility of 100% is not guaranteed. Basically, attempts are made to ensure availability as high as possible.
6. Terms of Payment
6.1 The basic version is generally available to all Users free of charge from the creation of an account. This basic version is fully playable and not limited in time. Not all features are available to Users in the basic version.
6.2 Additional features that are not available in the basic version are made available to the User against payment of a fee.
6.3 The User is not entitled to the payment of a price. A claim to the payment of a prize only exists after it has been publicly announced.
7. Obligations and Liability
7.1 We are not liable for any damage or loss of data that occurred during the installation or use of the Software.
7.2 The Game is made available by means of Client Software. The Software (Java) required for this is neither provided nor installed on the User’s Computer. No help is offered for the installation of the required Software. Rather, the User has to keep his Computer in such a state that it enables the use of the Game.
7.3 The User is obliged to keep his access data strictly secret and not to publish it in any other way. If data has been made available to unauthorized third parties, the User is advised to inform us of this by E-mail. Passwords should be changed regularly for security reasons. The user alone is responsible for the use of his account.
7.4 In the event of suspicion of the transfer of access data to third parties, we are entitled for security reasons to change the access data at our own discretion without prior notice or to block the account. The User has no right to restore the original access data.
7.5 The User has to follow the instructions of employees, Administrators and Moderators.
7.6 Under no circumstances does the User undertake to use the login data of another User.
